0 0 Blog Today we are continuing to discuss the important topic of wage theft. As Elizabeth, New Jersey’s premier workers’ compensation law firm, our lawyers represent and speak with New Jersey workers on a daily basis. In these discussions with our clients about their work-related injuries, we are also continuing to hear about wage theft and other aspects of employment law such as sexual harassment, gender discrimination and workplace retaliation. As we pointed out in our last post, wage theft involves workers who are paid less than the minimum wage, those denied overtime pay, employees forced to work off the clock, and those whose paycheck does not reflect the hours worked. A number of lawsuits centered around wage theft have made headlines in recent weeks, with two of them coming against 7-Eleven. In one of these cases, a Texas woman filed a lawsuit against 7-Eleven alleging unpaid wages. “According to the complaint, between August 2014 and Oct. 31, 2015, the plaintiff worked more than 40 hours per week but did not receive any overtime pay nor was she permitted to any breaks during her employment. The plaintiff alleges 7-Eleven failed to pay plaintiff minimum wage and any overtime pay for all hours worked in excess of 40 hours per week.” (setexasrecord.com) The other case was filed in New Jersey against a 7-Eleven store in Princeton by three former employees who are claiming they were victims of wage theft. The plaintiffs allege that they “were not paid when they started their employment in late 2015, never received overtime pay for the more than 70 hours a week they worked there and were paid below the $8.38 an hour (New Jersey) state minimum wage as manual laborers.” (centraljersey.com) This case has made a number of New Jersey headlines, especially among the Latin American community, who has shown strong support for these employees. The Latin American Legal Defense and Education Fund (LALDEF) has organized rallies in front of the New Jersey store, hoping to increase awareness in the community about the problem of wage theft.
