County Employees to Keep $3 Million Awarded in Age Discrimination

Six former employees of the Passaic County Prosecutor’s Office who won a wrongful-termination lawsuit in 2012 will get to keep the $3 million awarded to them, according to a published report.

The New Jersey Law Journal reports that the New Jersey Supreme Court declined to hear the government’s appeal of the ruling in Brown v. County of Passaic.

Six former investigators who were in their late 40s and early 50s sued the county in 2008 after they were fired in favor of younger employees.

Former county Prosecutor James Avigliano and the county maintained that the terminations of the older employees were necessary to reduce the number of total employees let go, The Record reported in June, after a state appeals court affirmed the ruling.

An employee union advised Avigliano to use a “last hired, first fired police” but he let six senior employees go instead, according to the Law Journal.

The employees argued that they were forced to take low-wage security jobs or were unable to find employment in law enforcement because of age restrictions, the report said.
